Store conditions

1. Purpose

These general terms and conditions govern access to and use of the online store available at www.luou.pt , owned by Origem Ibérica, Lda, a legal entity no. 508952310, with registered office at Rua de Luou, no. 242, 4990-745 Ponte de Lima. They set out the terms applicable to the purchase of products and services made available through the website.

2. Operation of the Online Store

The online store allows the user to:

• view the available offer (accommodation, products, experiences);

• create a customer account;

• place orders and make reservations;

• make secure payments;

• receive confirmation of purchase or reservation.

Use of the store implies conduct in good faith. Origem Ibérica, Lda reserves the right to suspend or cancel access to the online store in the event of non-compliance with these General Terms and Conditions.

3. Conditions of use

The user declares that they act as a consumer, under the terms of Law no. 24/96 of 31 July (Consumer Protection Law).

• Access to the online store may require the creation of an account, using truthful and up-to-date information.

• The user is responsible for maintaining the confidentiality of their credentials (email and password) and must not share them with third parties.

• In the event of loss, misappropriation or fraudulent use, the user must immediately inform Quinta de Luou.

• The creation of an account and use of the online store are free of charge (excluding telecommunications operator costs). Only the purchase of products or services gives rise to charges.

4. Ordering process

The user may make purchases as a guest or as a registered customer.
After submitting an order, the user will receive an automatic email acknowledging receipt of the order.
The contract shall only be deemed concluded upon the sending of an order confirmation email by Origem Ibérica, Lda.

4.1 Prices and payment

• All prices include VAT at the applicable legal rate.

• Prices are valid only for the period indicated and subject to available stock/availability.

• Accepted payment methods: credit/debit card and bank transfer (when available).

• The invoice is issued electronically after confirmation of the purchase or reservation.

5. Availability and delivery

• Processing begins after confirmation of payment.

• All product deliveries shall be carried out exclusively at Quinta de Luou, on a date and at a time to be agreed.

• In the event of unavailability, the customer will be informed and may:

  • accept an alternative product/service;

  • wait for restocking/availability; or

  • request a full refund, to be processed within a maximum period of 14 days.

6. Origin of live products and health responsibility

• Poultry marketed by Quinta de Luou, as well as any other products that may be available, namely fruit and vegetables, are marketed by Origem Ibérica, Lda, with production ensured by third-party local producers.

• All producers involved are duly licensed and authorised by the Directorate-General for Food and Veterinary Affairs (DGAV) and fully comply with the applicable legislation on animal health, animal welfare and food safety.

• Poultry is sold exclusively live, with no slaughtering, processing or handling carried out by Quinta de Luou.

• Responsibility for production, rearing and sanitary conditions up to the time of delivery lies with the respective producer, without prejudice to the legal obligations applicable to Origem Ibérica, Lda as the marketing entity.

7. Cancellations, exchanges and returns

Exchanges and returns are not accepted.

Origem Ibérica, Lda may cancel an order or reservation in the event of:

• unavailability of the product/service;

• failure to make payment within the indicated period;

• computer or typographical error affecting essential elements of the contract.

The customer may also cancel the order prior to its execution, except in cases of legal exclusion.

8. Personal data

The processing of personal data is governed by the Privacy and Cookies Policy of Quinta de Luou, available at www.luou.pt

9. Intellectual property

All website content (texts, images, logos, trademarks and others) is protected by copyright and industrial property rights.

Reproduction or use without the express authorisation of Origem Ibérica, Lda is prohibited and may give rise to civil and criminal liability.

10. Liability

The liability of Origem Ibérica, Lda is limited to direct and foreseeable damages resulting from contractual breach attributable to it.

It shall not be liable for:

• delays or failures attributable to third parties;

• improper use of the website by the user;

• force majeure events or circumstances beyond its reasonable control.

11. Alternative Dispute Resolution (ADR)

Under the terms of Law no. 144/2015, Origem Ibérica, Lda informs consumers that they may resort to:

• CIAB – Centro de Informação, Mediação e Arbitragem de Consumo (CIAB) – www.ciab.pt ; or

• the European Online Dispute Resolution Platform – ec.europa.eu/consumers/odr.

12. Partial invalidity

If any provision of these General Terms and Conditions is deemed invalid, this shall not affect the validity of the remaining clauses.

13. Applicable law and jurisdiction

These General Terms and Conditions are governed by Portuguese law. For any disputes arising from their interpretation or performance, the Court of the District of Viana do Castelo shall have jurisdiction, without prejudice to the consumer rights provided for by law.
